Welcome to Trimm International, Inc.TM Trimm Internationl, Inc. and its affiliates (“we”,”us”, “our” or “TII”) provide website features and other products and services (“Trimm Services”) to you subject to the following conditions (“Terms of Use”).
By using TII Services, you agree to these conditions. Please read them carefully.
We offer a wide range of Services, and additional terms may apply. When you use a Trimm Service (for example, Executive Life Coaching and Life Empowerment Program) you also will be subject to the guidelines, terms, and agreements applicable to that Trimm Service (“Service Terms”).
By accessing or using our sites and our services, you hereby agree to be bound by all terms incorporated herein by reference. If you do not expressly agree to all of the terms and conditions, then please do not access or use our site or our services. This Terms and conditions Agreement is effective as of 10/01/16.
1. Understanding
1.1 The following Terms and Conditions (TAC) is a legally binding agreement that shall govern the relationship with our users and all users who may interact or interface with Trimm International, Inc., its subsidiaries and affiliates, in association with the use of Trimm International, Inc.’s website, which includes but not limited to trimminternational.com; trimmcoaching.com; lifeempowerment.com; cindytrimmstore.com, and their services, which hall be defined below.
1.2 Any and all visitors to our site, who utilize any of our resource materials, despite whether they are registered as a site member or not, shall be deemed as “users” of the herein contained Services and resource materials provided for the purpose of this TAC. Additionally, once an individual registers for our services through the process of creating an account, the user shall then be considered a member, client, partner, associate, student and/or customer and shall be referred to as “user”.
2. Disclaimer of Warranties and Limitation of Liability
2.1 The user acknowledges and agrees that the Services provided and made available through our websites and applications, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of Trimm International Inc. At its discretion, Trimm International Inc. may offer additional website services and/or products, or update, modify or revise any current content and services, and this Agreement shall apply to any and all additional services and/or products and any and all updated, modified, or revised service sunless otherwise stipulated. Trimm International, Inc. does hereby reserve the right to cancel and cease offering any of the aforementioned services and/or products at its sole discretion, and without notice to the users. You, as the end user, accept and agree that Trimm International Inc., subsidiaries, staff, employees and owner(s) shall not be held liable for any such updates, modifications, revisions, suspensions or discontinuance of any of our services and/or products. We do not warrant that this Service, its servers, or e-mail or other notifications sent from us are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of this Service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
2.2 Further it is understood, that we do not hold ourselves out to be experts in the field of medicine or psychiatry. You therefore are advised that should medical or psychiatric services be need it is the sole responsibility of the end user to secure such services. Your continued use of the services provided, after such posting of any updates, changes, and/or modifications hall constitute your acceptance of such updates, changes and/or modifications, as such, frequent review of this Agreement and any and all applicable terms, conditions and policies should be made by you to ensure you are aware of all terms and policies currently in effect. Should you not agree to the updated, modified or revised terms and conditions, you must stop using the provided services.
2.3 Furthermore, the user understands, acknowledges and agrees that the services offered shall be provided “AS IS” and as such Trimm International, Inc. shall not assume any responsibility or obligations for the timeliness, missed delivery, deletion and/or any failure to store user content, communication or personalization settings.
3. Services Descriptions
3.1 Trimm International, Inc. attempts to be as accurate as possible. However, we do not warrant that descriptions of services or other content of this Service is accurate, complete, reliable, current, or error-free. We provide links to other sites over which we no control. We are not responsible for the availability of such external sites or resources and we do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.
4. Coaching
4.1 The term “coaching” as here used comprises life coaching, personal coaching, executive coaching, leadership coaching, and business coaching and where applicable includes mentoring, training, facilitations, lecturing, consulting and/or supervisory services provided for users and/or others.
Coaching, as referenced here, is not psychological counseling or any other type of therapy, and should not be construed as such.
4.2 In return for the fees payable by the User (or by a third party on their behalf), Trimm International Inc. and its subsidiaries agrees to provide the services as described below and in accordance with the terms and conditions outlined therein. The User agrees to pay such fees for services rendered on the terms and conditions set out below. In situations where a third party pays the fees, the third party acts as an agent on behalf of the User, the third party shall be treated as a User, and therefore is expected to abide by the same terms and conditions.
4.3 As it relates to our coaching services, the date of the first coaching session represents inception of services delivered.
5. Terms of Sale
5.1 The User agrees that TII may charge the User’s designated payment method for any products purchased or for any additional amounts (including any taxes and late fees, as applicable) that may accrue throughout the duration of a particular service or program. The User is responsible for providing TII with a valid payment method and for the timely payment of all fees.
5.2 The User’s total cost will include the price of the product plus any applicable tax (such tax is based on the bill-to address and the tax rate in effect at the time the service/product is purchased).
5.3 Prices for products offered via the Services may change at any time, and the Services do not provide price protection or refunds in the event of a price reduction or promotional offering.
6. Refunds
6.1 All sales are final and payments made to Trimm International, Inc. TM for Executive Life Coaching are nonrefundable and nontransferable. Products purchased through third party vendor or site is subject to the terms of sale for that vendor.
7. Responsibility & Commitment
7.1 Trimm International Inc. and its subsidiaries will seek to empower the user, helping them to set and achieve goals that will help to bring about desired outcomes. The user has sole responsibility for any decisions made following a coaching relationship with us, and as such does not accept any liability for the User’s actions or any loss incurred by user, or for any perceived failure by the user, whether justified or otherwise, to achieve a material improvement in quality of life or to achieve their desired outcomes, goals, whether financial or otherwise, following commencement of coaching sessions.
7.2 Concerning Coaching Services, the user will be required to complete a “Commitment to Coaching” form at the commencement of the program wherein the user will be asked if they are ready to take the necessary steps to make change and growth possible.
8. Confidentiality
8.1 Personal information or business information supplied to Trimm International, Inc. and/or its subsidiaries by the user in any coaching interaction will be treated as confidential. It will not be disclosed to a third party without the user’s prior permission, unless in the unlikely event that Trimm International Inc. is required to do so by law.
8.2 Trimm International Inc. and the user will be required to sign a Confidentiality Agreement at the commencement of services. We will respect the User’s privacy and seek written permission before disclosing information about the User’s relationship with Trimm International Inc.
8.3 We require that the user provide an emergency contact name and telephone number to be used only in the event of an emergency, such as sudden illness or accident.
8.4 All documentation and information relating to the user will be held according to the Data Protection Act 1998, except as permitted by the user in writing or as required by law.
9. Clarity
9.1 The user has the right to talk openly and candidly with their Service Provider (coach, consultant, mentor, facilitator, and or trainer) and is encouraged to discuss any concerns they have with Trimm International Inc. in regards to any area of the service process. We welcome openness and honesty.

9.2 We are continually striving to ensure the standard of service that we provide to our users remains outstanding. At the end of the coaching process, or series of coaching sessions, the User will be asked to complete a feedback form.
10. Coaching Procedure
10.1 The group coaching schedule will be provided to the user upon enrollment, while individual coaching sessions are schedule by the client and can be booked up to three months in advance.
10.2 Executive Life Coaching offers one-on-one coaching to participants on a monthly basis, while Trimm International Inc. reserves the right to recommend the frequency of coaching sessions based on a professional assessment of the user’s requirements.
10.3 Supplementary coaching sessions are available for an additional fee at the rate provided on the trimmcoaching.com website. This recommendation, or plan, is not binding and may be altered and adjusted throughout the coaching journey by mutual agreement, in accordance with the terms set out here.
10.4 The number of coaching sessions that the user receives is based upon the service plan that the user has subscribed to. Where no specific number is agreed upon, meeting frequency will be determined on a session-by-session basis. Full payment is due before or at the first session. Additional sessions can be booked thereafter.
10.5 The length of each session is usually one hour, but can be decided between Trimm International Inc. and the user at the commencement of the program.
10.6 Sessions will take place via GoToMeeting for group coaching, or via Skype or phone for individual coaching (client calls coach).
10.7 We may assign the user tasks or exercises to complete between coaching sessions. There is no obligation for the User to complete these tasks, but not doing so may slow the user’s progress in achieving desired outcomes. Where applicable, Users may be requested to submit assignments at least 24 hours before the coaching session so they can be reviewed and feedback given during the session.
10.8 The user may contact Trimm International Inc. by phone at 678-565-9888 ext. 3 or by email at lifecoach@trimminternational.com between sessions to share a success or seek clarification on a coaching issue. Support between sessions is seen by us as a necessary part of the coaching process. Trimm International Inc. will always advise the user in advance if the nature of the users contact is likely to incur an additional charge, and no such charges will be imposed without the user’s agreement.
11. Cancellation & Rescheduling Sessions
11.1 If the user needs to reschedule a coaching session, they should provide 48-hour notice. No refunds will be given to the user for unused coaching sessions. In exceptional circumstances, Trimm International Inc. may need to reschedule a coaching session; in these circumstances Trimm International Inc. will use reasonable endeavors to provide a mutually satisfactory alternative appointment for the user.
11.2 Where the user pays for a session, or sessions, in advance, the coaching session(s) must take place within three months of payment, or the fee is forfeited.
11.3 The user may terminate their coaching contract at any time in writing. Any monies owed at the time of cancellation will become due immediately. All sales are final and payments made to Trimm International, Inc. TM for Executive Life Coaching are nonrefundable and nontransferable.
11.4 In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behavior by the user, actual or potential conflict of interest, or other reasons, Trimm International Inc. can decide to terminate its services to the client early. In such a circumstance, the user will be given reasonable notice of termination by Trimm International Inc. where practicable, and will be refunded any advance payments made for coaching sessions not yet provided.
11.5 There may be occasions when we recommend that the user seek an alternative service more suited to their current needs. In this event, we will fully disclose the reasons for the recommendation with the user. It is the user’s sole responsibility to decide whether to follow the recommendation; in whichever manner the user chooses to proceed, Trimm International Inc. does not accept liability for the outcome.
12. Intellectual Property
12.1 By enrolling in Executive Life Coaching, you agree that Trimm International Inc. and/or its subsidiary —including but not limited to its products, graphics, user interface, audio clips, video clips, editorial content, and the scripts and software used to implement its services—contain proprietary information and material that is owned by TII and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree not to use such proprietary information or materials in any way whatsoever except for use within the context of the Executive Life Coaching program in which you are enrolled in compliance with this Agreement. No portion of the program or its related services may be reproduced in any form or by any means, except as expressly permitted in these Terms & Conditions. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on these service offerings owned by Trimm International Inc. in any manner, and you shall not exploit the Executive Life Coaching program or any other of our Services in any unauthorized way whatsoever, including, but not limited to, by trespass or burdening network capacity.
12.2 Notwithstanding any other provision of this Agreement, Trimm International Inc. and its licensors reserve the right to change, suspend, remove, or disable access to any of our products, content, or other materials comprising any part of the service offerings at any time without notice. In no event will we be liable for making these changes. We may also impose limits on the use of or access to certain features or portions of it services without notice or liability.
12.3 All Service and Product copyrights, including the compilation of content, postings, links to other Internet resources, and descriptions of those resources, and any related software are owned by us and/or our licensors, who reserve all rights in law and equity. THE USE OF THE SOFTWARE, WEBSITE, RESOURCE MATERIALS OR ANY PART OF THE TII SERVICE SPECTRUM, EXCEPT FOR USE OF THE SERVICE AS PERMITTED IN THIS AGREEMENT, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT INFRINGEMENT.
12.4 The Executive Life Coaching, Trimm International, Inc., Trimm Institute for Global Leadership, Cindy Trimm logo, and other trademarks, service marks, graphics, and logos used in connection with these services are trademarks or registered trademarks of Trimm Internatioanl, Inc. TM in the U.S. and/or other countries. Other trademarks, service marks, graphics, and logos used in connection with Trimm Internatioanl, Inc. TM or any of its initiatives, may be the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.
12.5 It is further understood that on occasion we may record our trainers delivering the Service content during your attendance. You authorize us to use your image and voice in any such recordings without payment, other condition or need for further consent.
